HEXASPEAR Intelligence ("Platform") is operated by Deepsara AI LLP ("Company", "we", "us", "our"), a limited liability partnership registered under the laws of India.

WHAT IS HEXASPEAR INTELLIGENCE

HEXASPEAR Intelligence is a strategic intelligence platform operated by Deepsara AI LLP. It provides:

  • Strategic Insights — AI-curated daily intelligence briefs covering global power shifts, capital movements, geopolitical changes, and policy dynamics.
  • GROW Library — Compressed key insights and summaries from non-fiction books, designed for personal educational use.
  • Learning Content — Curated articles, knowledge resources, and analytical pieces for strategic thinkers, decision-makers, and builders.
  • Personal Reflection Tools — A private local journaling workspace for personal knowledge synthesis. Reflection data is stored only on your device and is never transmitted to or stored on our servers.

ELIGIBILITY

You must be at least 18 years of age to use this Platform. By using it, you represent and warrant that you are 18 or older.

We reserve the right to terminate accounts of users found to be under 18 without notice.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use Platform content for personal, non-commercial purposes only.

Your Personal Reflections remain entirely yours. Deepsara AI LLP claims no rights over your reflection content. Reflection content is never accessed, stored, or processed by our servers — it exists only on your device.

ADVERTISING

This Platform displays advertisements via Google AdSense. Google and its partners use cookies, web beacons, and similar tracking technologies to serve ads based on your browsing activity on this and other websites.

LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DEEPSARA AI LLP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL — ARISING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

AGGREGATE LIABILITY CAP: To the extent any liability is found, Deepsara AI LLP's maximum aggregate liability to you for any and all claims arising from or related to these Terms or your use of the Platform shall not exceed the total amounts actually paid by you to Deepsara AI LLP in the twelve (12) months preceding the date the claim arose, subject to an absolute maximum cap of INR 500 (Indian Rupees Five Hundred). For users who have not paid any amounts (free users), this cap is INR 0 (zero).

Some jurisdictions do not allow the exclusion of certain warranties or limitation of certain liabilities. If such laws apply to you, some of the above limitations may not apply, but our liability in such cases shall be limited to the minimum extent permitted by applicable law.

GOVERNING LAW & JURISDICTION

These Terms are governed by and construed in accordance with the laws of India, including the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of Salem, Tamil Nadu, India.

In accordance with the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, the details of the Grievance Officer are:

The Grievance Officer will acknowledge your complaint within 24 hours and resolve it within 15 days of receipt.

CHANGES TO THESE TERMS

We may update these Terms at any time. We will notify registered users of material changes via the Platform at least 7 days before the changes take effect. Continued use of the Platform after any changes constitutes your acceptance of the revised Terms.

If you do not agree to the revised Terms, you must stop using the Platform and may delete your account.

INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Deepsara AI LLP, its founders, officers, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to:

  • Your use or misuse of the Platform
  • Your violation of these Terms or any applicable law, rule, or regulation
  • Your infringement or misappropriation of any third-party intellectual property, privacy, or other rights
  • Any dispute or transaction between you and any third party in connection with the Platform
  • Any content or information you submit, upload, or transmit through the Platform

Deepsara AI LLP reserves the right, at its own expense, to assume the exclusive defence and control of any matter subject to indemnification by you, in which case you agree to cooperate fully with us in asserting any available defences.

FORCE MAJEURE

Deepsara AI LLP shall not be liable for any failure or delay in performance arising from circumstances beyond our reasonable control, including but not limited to:

  • Acts of God, natural disasters, floods, earthquakes, or severe weather events
  • Government actions, regulations, orders, or sanctions
  • Internet or telecommunications infrastructure failures
  • Cyberattacks, hacking, or distributed denial-of-service (DDoS) attacks on our infrastructure or third-party providers
  • Failures of third-party service providers including Google Firebase, Cloudflare, or Google AdSense
  • Power outages or utility failures
  • Pandemic, epidemic, or public health emergencies
  • Civil unrest, war, or acts of terrorism

In such events, our obligations under these Terms are suspended for the duration of the force majeure event. We will use reasonable efforts to notify users and to resume normal operations as soon as practicable.

DISPUTE RESOLUTION & ARBITRATION

Step 1 — Informal Resolution (Mandatory First Step): Before initiating any formal proceedings, you agree to first contact us at hexaspear@gmail.com with a written description of your dispute and your proposed resolution. We will attempt to resolve disputes informally within 30 days of receipt.

Step 2 — Arbitration: If informal resolution fails, disputes shall be referred to a sole arbitrator appointed by mutual agreement of the parties, under the Arbitration and Conciliation Act, 1996 (India). The seat and venue of arbitration shall be Salem, Tamil Nadu, India. Proceedings shall be conducted in English.

Step 3 — Courts: If arbitration is waived by both parties in writing or is not applicable to the nature of the dispute, matters shall be subject to the exclusive jurisdiction of the courts of Salem, Tamil Nadu, India.

Individual Disputes Only: You agree that any dispute resolution — whether informal, arbitration, or litigation — shall be conducted on an individual basis only. You waive any right to participate in class-action, collective, or representative proceedings against Deepsara AI LLP.

Costs: Each party shall bear its own legal costs unless a court or arbitrator awards costs against a party for bad faith conduct.

SEVERABILITY & ENTIRE AGREEMENT

Severability: If any provision of these Terms is found by a court or arbitrator to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable. The remaining provisions shall continue in full force and effect.

Entire Agreement: These Terms, together with our Privacy Policy, Cookie Policy, Community Guidelines, and Disclaimer, constitute the entire agreement between you and Deepsara AI LLP with respect to your use of the Platform and supersede all prior agreements, understandings, or representations.

No Waiver: No failure or delay by Deepsara AI LLP to exercise any right or remedy under these Terms shall be construed as a waiver of that or any other right or remedy in the future.

No Partnership: Nothing in these Terms creates any partnership, joint venture, agency, employment, or franchise relationship between you and Deepsara AI LLP.

Assignment: You may not assign or transfer your account or rights under these Terms to any third party without our prior written consent. Deepsara AI LLP may assign these Terms and any rights hereunder to any successor entity, affiliate, or acquirer without your consent.
